By accessing or using the EurekaIQ platform at eurekaiq.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account.

3. Subscription and Billing

• Plans and Pricing: EurekaIQ offers paid subscription plans as described on our pricing page. Prices are subject to change with reasonable notice.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• Payment: All payments are processed securely through Stripe. You authorize us to charge your payment method for recurring subscription fees.

4. Acceptable Use

You agree not to:

• Use automated tools, bots, or scrapers to extract data from the platform beyond normal use of the Service.
• Send spam, unsolicited bulk messages, or messages that violate CAN-SPAM or other applicable anti-spam laws using data obtained through the platform.
• Attempt to gain unauthorized access to our systems, infrastructure, or other users' accounts.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Resell, redistribute, or sublicense access to the Service or data obtained through it without our written consent.
• Interfere with or disrupt the integrity or performance of the Service.

5. Intellectual Property

The Service, including its design, features, AI models, and content, is owned by EurekaIQ and protected by intellectual property laws. You retain ownership of any data you input into or generate through the Service. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.

6. Limitation of Liability

To the maximum extent permitted by law, EurekaIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee the accuracy of AI-generated prospect data, contact information, or email content. You are responsible for verifying any information obtained through the Service before acting on it.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
